Please read these terms carefully before using our products and services.

1. Acceptance of Terms

By accessing or using any website, mobile application, software, or service provided by ZairLabs ("we," "us," or "our"), including but not limited to SafarDesk, Focus or Fail, Zair Finance, ZairLingo, Jamia Sync, Blog Vibes, Qaza Keeper, and ReadOut, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

2. Product-Specific Terms

Different terms apply depending on the specific ZairLabs product you are using:

2.1 Local-First Applications

For our offline-first and local-storage applications (Focus or Fail, Qaza Keeper, Notes Of Me, ReadOut):

  • License Grant: We grant you a personal, non-exclusive, non-transferable license to install and use the application on your devices.
  • Data Responsibility: These applications store data locally on your device. We do not maintain a cloud backup of your content. You are solely responsible for backing up your data. ZairLabs is not liable for data loss due to device failure, app uninstallation, or corruption.
  • No Warranty: These apps are provided "as is." While we strive for stability, we do not guarantee they will be error-free.

2.2 SaaS & Cloud Solutions

For our cloud-based platforms (SafarDesk, Jamia Sync):

  • Subscription: Access is provided on a subscription basis. Failure to pay may result in suspension of access.
  • Availability: We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance.
  • Fair Use: You agree not to abuse the system resources or attempt to reverse-engineer our APIs.

2.3 Financial Tools

For Zair Finance:

  • Not Financial Advice: This software is a tool for record-keeping and accounting. ZairLabs does not provide financial, tax, or legal advice.
  • Accuracy: While we ensure calculation accuracy, you are responsible for verifying your financial data and reports.

2.4 Desktop Tools

For ZairLingo:

  • API Usage: Translation services may rely on third-party APIs. Excessive usage beyond your plan limits may be throttled or charged.
  • Updates: We may push automatic updates to improve security and functionality.

2.5 Open Source Software

For Blog Vibes:

  • License: The source code is provided under the specific open-source license (e.g., MIT, GPL) included in the repository.
  • Contributions: By contributing code, you agree to license your contribution under the project's terms.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. ZairLabs is not liable for any loss or damage arising from your failure to protect your password.

4. Payment Terms

  • Pricing: Prices for our products are listed on our Pricing Page and are subject to change with notice.
  • Billing Cycle: Subscriptions are billed in advance on a recurring basis (monthly or annually) as selected at checkout.
  • Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing period. We do not provide refunds for partial months or unused time.
  • Taxes: You are responsible for any applicable taxes based on your location.

5. Refund Policy

We want you to be completely satisfied with our products. Our refund policy is designed to be fair and transparent.

5.1 SaaS Subscriptions (SafarDesk, Jamia Sync)

  • 14-Day Money-Back Guarantee: If you are not satisfied with your new subscription, you may request a full refund within 14 days of your initial purchase.
  • Eligibility: This applies only to the first billing cycle of a new subscription. Renewals are not eligible for refunds unless there was a billing error.

5.2 One-Time Purchases (Zair Finance, Desktop Tools)

  • 7-Day Window: Refundable within 7 days of purchase if and only if the license key has not been activated or used.
  • Defective Software: If the software is technically defective and our support team cannot resolve the issue within a reasonable timeframe, you are eligible for a full refund regardless of activation status, provided the request is made within 30 days of purchase.

5.3 Non-Refundable Items

  • Custom Services: Fees for custom development, setup, or consulting services are non-refundable once the work has commenced.
  • Downloadable Assets: Digital templates or assets that can be copied are non-refundable once downloaded.

5.4 Dispute Resolution

Before filing a chargeback with your bank, we encourage you to contact us. We aim to resolve all billing disputes amicably and quickly. Unjustified chargebacks may result in a permanent ban from all ZairLabs services.

6. Intellectual Property

Our IP: ZairLabs retains all rights, title, and interest in our software, logos, and trademarks.

Your Data: You retain full ownership of the data you enter into our systems. We claim no intellectual property rights over your personal data, journal entries, financial records, or content.

7. Prohibited Activities

You agree not to:

  • Use our services for any illegal purpose.
  • Attempt to gain unauthorized access to our servers or networks.
  • Harass, abuse, or harm another person via our platforms.
  • Upload malicious code or viruses.

8. Termination

We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

9. Limitation of Liability

To the fullest extent permitted by law, ZairLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or a prominent notice on our website. Your continued use of the service after changes constitutes acceptance.
